Does ADA apply to this circumstance? And if it does, isn't there an enforcement mechanism?

I assume there are lots of legitimate reasons that people cannot wear masks. I also understand stores setting their own policies of their own volition (and support their right to do so). It is just a shame that said policies are based more out of ignorance and fear than out of sound science and reason. (For example: masks are supposed to mitigate when social distancing cannot be maintained. So, why would a store that is already enforcing social distancing also need to require masks?)

Yes ADA still applies. What sense does it make to force a person to do something that triggers or makes their disability worse?

The actual ADA enforcement mechanism is terrible. There is nothing to help you out immediately. You have to deal with the embarrassment and inconvience then.

1. Call local LEOs, they don't do anything
2. Call DOJ (ADA enforcement) they don't answer
3. File a complaint with the DoJ
4. Wait weeks and get a form letter saying they are to busy, but you can file a civil suit.


Something like 8 out of every 10 DoJ complaints get ignored or kicked down the street. The DoJ only wants to get involved when it's a lawsuit against Walmart not when it's Joe's mom and pop shop. The DoJ will also decide to interject themselves in a civil case, even after saying they are to busy if they smell blood in the water and a chance to get some money.

The only saving grace is Indiana has the ICRC, and I swear they are some pit bulls just looking to bite someone.

It's usually about 10 times worse when you have a service dog.

Just like hotels having the indoor pool close. That water has so much chlorine ain't no 'rona gonna be in it.

As for ocean/lake water. Come on 'rona wont be in that either. But again those making decisions are stupid and I'll informed.

Why would you take the time to make something that's not effective?

Masks filter down to .3 micron and coronavirus is .125 micron..

I've always said these cloth masks and crocheted masks are as effective as a condom with a bunch of holes in it.

Some protection is better than none.

Wearing a cotton handkerchief gives you a 28% protection.
Wearing the surgical mask give you 80%
Respirators give you 98% to 99% depending on the cartidge.
So it's all a matter of your risk level.

I've yet to see anyone wearing a crocheted mask. (they're out there, just very rare)

and 1/8 micron isn't he goal, you just need to stop the vehicle on which the coronavirus is riding. Just imagine there's a bunch of virii in a jumbo jet.

If drywall dust can get through a surgical type mask, imagine what a virus can do. I went to Menards on April 30th and haven't been back since because of the mask policy. Wear one if you want, but don't force your opinion of them on others. Especially when I see half the people that use them take them down to talk, don't cover noses, or wear them around their neck at the grocery store.

It's seems that sentiment is rare in the public at large - their parking lot (Ft Wayne West) was packed on Saturday.

I kind of like it, everyone can be a bit safer, all while pretending they hate "the man" for telling them to wear a mask.
