    Yeah, just didn't see it till after I posted it.. I would think it should count as official record. I'm sure the stenographer (sp?) typed it up. Why would it not be official?


    All depends on when it was said to the judge, and what was actually written on the "official piece of paper" Also a prosecutor does not have to fill all the charges. A Jury can convict on a lesser charge even if it is not requested by the prosecutor, or at least that is the way it was explained to me. Although I am not sure the same holds true in other states.

    Yeah, my point though, is that they should be allowed to say not guilty on the one charge while still calling a mistrial on the other two charges...seems bogus.
