    Why young (18+)? Because he wasn't looking for a relationship. She was on a sugar daddy website. This, so far, isn't a guy who set out to have sex or film underage girls. He was lied to, paid for her "time" and engaged in intimate acts (allegedly).

    I think the prostitution aspect is far less serious than boffing underage kids, and so does the State of Texas. Straight prostitution is a Class A Misdemeanor, sexual assault of a child is Second Degree Felony. Sorry but going to a site called SugarDaddies or whatever for "female companionship" and expecting a click to assure complete reliability doesn't pass the reasonable person test. I would bet that that website has all kinds of stipulations that it only provides consenting adults a way to meet, relies on all subscribers to be honest, blah blah blah. Thus it puts vetting your date squarely on your shoulders (as does the law). The site's owners will argue that what Cody and the girl did was completely outside the bounds of the agreement they clicked on at the website, and they're shocked, shocked, that prostitution and sexual assault occurred. I'll bet they cancel Cody's membership even.

    And barring some unusual unknown exoneration popping up soon, I look down on Cody who makes neat guns more than Jared because of the stench he just inflicted on the 2A. And I think Jared was creepy scumbag.

    Honestly? No. Assuming no human trafficking and if she were of age to consent, meh. Now if he knew she was underage, or reasonably should have known, completely different ballgame. If someone wants to pay or be paid for what they could do for free, while not exactly what I'd consider moral behavior, not something I'm going to get worked up over.

    Thank you! Wasn’t sure why it wasn’t mentioned before, seems at the least it would be an added charge but I’m not a lawyer and have no clue how that works. As for the underage thing, I get what you’re saying with the verifying age on the site not being a reasonable person test that would be reliable enough to make the assumption she is of legal age, but if he wasn’t informed of her age does he have a duty to ask since the place they met requires her to be an adult? As someone else said earlier, couldn’t that be in the same category as meeting someone in a bar, where they’re required to be of a certain age to be in that area? Just curious cause I really don’t know how the online dating thing works, I prefer to meet my women in person (before I got married that is:):)

    Almost certainly still illegal, but usually a misdemeanor charge so they may not have bothered in comparison to the Felonies.

    Dude sounds scummy and I’m not surprised he ran. Most any chance he had of a jury nullifying based on the age issue probably walked due to the nature of the transaction.

    It could be, but it's very routine not to charge misdemeanors along with high level felonies. The "main charge" here is a level 2 felony, so potential decades in jail. Prostitution/soliciting is a misdemeanor, and at least locally it's a small fine and time served sort of thing. Not worth bothering with when you've already got the felony charge. Especially when it can be confusing to a jury. To make the underage thing stick you have to argue one side doesn't have the legal authority to consent. If one side doesn't consent, is it prostitution or rape? See the issue and why it's not worth it to charge it?

    Fair question, but hard to answer. Fogle had several more crimes than just banging a slightly underage girl, one that would have possibly been legal in this state. IIRC Possession of child porn and solicitation of the same with much younger girls.

    Pretty much, how many of us haven't sold our bodies? Maybe not that specific part or for that type of job, but I'm pretty sure most of us have done some form of labor. And probably for a heck of a lot less per hr.

    "My side", or the "other side"... if he's guilty, follow through with proscribed punishment. If he's innocent, let him go.

    pkus at this point the files are out in the wild and based on the judge ruling his biz can sell them so can anyone else just upload them like they are now for free? doubt his biz goes after them as the whole point was to get the files out to the public.

    I know they do, but I don't like the argument of charging juveniles for prostitution. If you can't legally consent to sex, how can you legally consent to sex for money? Plus, someone who's at a stage in their life where as a juvenile they are taking money for sex, a criminal record probably isn't going to stop them from doing it and will likely contribute to keeping them there.
