Here is the list of charhed the new DA will not prosecute for.

Interfering with a peace officer or parole and probation officer
Disorderly conduct in the second degree
Criminal trespass in the first and second degree
Escape in the third degree
Harassment
Riot (unless accompanied by a charge outside of this list)

So if you root and the police arrest you they need to charge you with riot + something else for the DA to look into it.
Seems to me if you are part of a violent crowd that say throws bricks at Joe's coffee shop but you just stand their while others go in and loot it of you get arrested no charges for you as you are just rioting.

If you riot (ie throw that stone) and then walk into the coffee shop and take the coffee you are looting as well so charges for you.
