    I'm thinking the homeowner was actually kind of ambivalent about really using his handgun. Especially facing an opponent who had a hatchet and his hand on his gun as well. :rolleyes:

    Oh, and before anyone else can jump in, "What was his INGO screen name?"
    MIDDLETOWN, OH (FOX19) - A hatchet-wielding man snuck into a stranger's house and was found pantsless in the homeowner's bed Friday, according to Middletown police records.
    Middletown police were called to the 1300 block of Woodlawn Avenue on a report of a burglary early Friday morning.

    Kaylie Stacy found Michael Robert McClain, 39, "with his pants down, holding his penis with his right hand and had a hatchet, deadly weapon, in his left hand," the police report states.

    "I came in, and my bedroom light was on, which is never left on we always turn it off," she said.

    Stacy asked her husband Tim to help get McClain out of the residence. He was armed with a gun when he tried to wake up McClain, police said.

    He told police he was in fear for himself and his family so he struck McClain in the head with the handgun. A fight then ensued.

    After an extended "fight" and two warning shots (into the ground, he must have been reading INGO), the pantless intruder was found nearby by police.

    Holy crap, they had on DEA printed shirts and screamed DEA when they rushed to her porch. That would be tough to figure out in the mix.

    Man drives off would-be kidnapper using four warning shots (into the ground):

    Man posing as a CPS worker allegedly tried to take 3 children from Texas home

    A man was arrested on Saturday, July 14, after allegedly breaking into a Liberty County home under the false pretense that he worked for Child Protective Services and trying to take three children who lived there.

    According to ABC 13, Jimmy Dwayne Lackey, 37, is accused of entering the home and charging after an adult male who was also living there. Lackey allegedly planned on killing the man before kidnapping the children.

    The four victims hid inside a bedroom and the male victim grabbed a gun and fired four shots into the ground. According to the Montgomery County Police Reporter, they were then able to get to a neighbor's home to call 911.

    The intruder tried to escape when police arrived. He is charged with burglary of a habitation with intent to commit another felony, impersonating a public servant, possession of a controlled substance, and resisting arrest.


    Texas law says you are justified to use deadly force in defense of self or others against someone who has unlawfully with force entered an occupied habitation, to prevent aggravated kidnapping, or to prevent imminent deadly force or serious bodily injury to one's self or another. Depending on the exact details of the incident, the intruder may have qualified for all three ways to be shot. I'm guessing that the man defending the children didn't want to shoot the intruder because a) he wasn't sure of his legal justification as it appears from the story the intruder was not armed with a weapon, or b) he did not want to open the door to the room where they were hiding.

    Was he carrying with an empty chamber? Running at full speed it looks like he tried to rack the slide, failed and then did it again right before the BG got in there.

    Wow, he was perfectly calm. Kept the guy down without making a bunch of death threats. LEO shows up, he puts the gun down and raises his hands. I would say that was text book.

    At first I thought that laying the gun down and turning away was a mistake, then they shows the fence was right at the curb.
