sounds like the defense could make a case for police harassment however...

Walker said he observed 25-year-old Ryan Stephens with his face about 2 inches from the rear window of the police vehicle, barking and hissing at Timber.
When Walker questioned Stephens about why he was barking at the dog, Stephens replied, "He started it. He was harassing me."

    Well lets see........
This happened in front of a Bar. :n00b:
The suspect smelled of alcohol. :n00b:
He said the dog was harassing him. :n00b:
    Yup!
That gets three "Stupids" in my book.

I agree with you 100%. Stupid isn't against the law, however. If the dog is so volatile that it is considered harassment to mockingly bark at it why didn't the officer inform that man as such and give him the chance to leave?

Because the law applies to teasing all police dogs, not just Timber, If the dog had simply ignored the dude and laid in the back seat sleeping, it is still harassment

Actually it's a "Rule of thumb"
Three "stupids" almost always earns someone a trip before the Judge. :D

"What are you charging this guy with?"

    "He committed Three Stupids, UncleMike."

"Oh, hell then. Book him for anything. Heck, book him for barking at a dog if you want."

    Todays word is: discretion

If you act like an ass they have the "right" to use their discretion to lock you up.
If your not an ass and make it easier on them they use discretion to help you out. (aka go home at night and lay down with your wife instead of bubba from cell block C).

Looks to me like the guy is going to end up a Darwin Award Winner some day.

This is covered by the Duke quote, Life is tough, but it is tougher if you are stupid.
