Sale is a noun. Sell is a verb.

    They are not generally interchangeable.

I'll just stop there for now. :)

From my understanding, if you are buying and selling for profit, you must have an FFL. If you are selling to create funds for a new weapon, you don't need a license. I have seen no numbers inthe US Code.

Is there a number of person to person sales I can engage in before I am required to have an FFL license? I am concerned that I won't get an accurate answer from my LGS since they are trying to protect their sales. A police officer I asked told me he didn't know the limit.

Does anyone have an idea other than use your best judgement?

    Thanks for any input

    To Hillbilly41 (et alia),

First, I am not a lawyer.

The basic premise is that you cannot be engaged in the sale of firearms as a business without a license, period.

There is NO magick number regarding this. What there would wind up being is how easy of a case could the BATFE make in sending you to prison?

Example, some guy goes to gun shows selling from his "private collection." He has also been adding to his "private collection" over the last eight (8) years and selling out of that. Guess what? It is likely there is a room reserved for him somewhere in federal prison. He isn't some guy that started at 200 firearms and is working his way down to zero (0). If that were the case he could easily prove he was simply liquidating.

Let us suppose someone who is very good with their hands buys beat up firearms, repairs and refurbishes them to a very nice condition, then turns around and sells them for a profit. Again, easy to prove operating as a business.

In the end the law doesn't matter. What matters is the appearance of how you are acting and how easily that could be sold to a jury.

    Regards,

    Doug

Please proofread before posting. Your post was painful to read. It reflects poorly on you and the schools you attended (if any).

Aw, come on gentlemen, don't pick on the guy on Christmas. Besides, he probably graduated from a public school where the curiculum was modified to accomodate future followers of obumma.
