    SCOTUS grants Writ of Certiorari Petition for Smith & Wesson Brands, et al. v. Estados Unidos Mexicanos

    SCOTUS Decision should be rendered by June 2025.

    This is the lawsuit by Mexico seeking damages from U..S. firearm manufacturers for guns that have been used to commit crimes in Mexico, including those used by Mexican drug cartels. Mexico was aided by Jonathan E. Lowy, formerly Lead Counsel for Brady, United Against Gun Violence until 2022. That same year, he founded Global Action on Gun Violence and is currently its President. His first project in his new organization was filing the $10 Billion lawsuit for Mexico. The motive should be obvious: bankrupting all gun manufacturers into oblivion. Originally filed against seven (??) manufacturers, the lawsuit was dismissed for all but two, one of them Smith & Wesson. It's clear to even the most casual of observers that it's a legal strategy to attempt an end run around the PLCAA. If Mexico prevails, Lowy, et al, will be facilitating lawsuits against U.S firearm manufacturers by every foreign country willing to sign their name to one.

    I expect major considerations will be whether Mexico as a sovereign nation has "standing" to bring such a lawsuit, and whether the PLCAA prohibits sovereign nations from suing firearm manufacturers. Mexico had prevailed thus far in the lower courts (Lowy did jurisdiction shopping to get most favorable venues). SCOTUS accepting the case bodes well for it at the outset. That said, SCOTUS dealing with a lawsuit brought by a sovereign entity against US entities is among its major responsibilities under Article III of the Constitution.

    Mexico is just full of pathetic idiots trying to make a buck at the expense of a United States business.
    And I have great contempt for the American lawyers helping the a$$hats in Mexico!
    If the police and politicians in Mexico were not so corrupted by accepting $$$ from the criminals and cartels at all levels maybe the crime situation in Mexico would diminish!
