The release was exactly a political move. Chutkan gave Smith an open pass to file out of normal procedure first and then release the brief publicly now specifically to get it in the public domain last minute to try and affect the election after his efforts failed to get it to trial.

Smith desperately wanted to be the hero and get a trial conducted and get a conviction before the election. He came up empty handed twice and the Judge threw him this bone to run with as a last attempt to affect the election.
