Please don't think I'm arguing with you, I'm wanting to learn. Here's a scenario, when are the police actions illegal?
MWAG on public property.
1 approach and ask for LTCH
2 state that they received a call
3 state that OC can cause people to call police
4 ask if OCer would be willing to conceal, or
4 tell OCer that they need to conceal
5 escort OC er off property.
...and I as well.I just posted on his Facebook page.
My response:Bruce Campbell As a firearms instructor I don't necessarily agree with people wanting to open carry. I don't have a problem that it is legal however, It's just something that I believe makes one a target instead of a deterrent. That being said, this person was within his rights. I would also like to see Indiana adopt a policy that all applicants must obtain some formal training such as an NRA firearms class or a CCW class from a certified instructor from another State. Although I am a firm believer in the 2nd amendment, I have seen far too many people come to my CCW classes that are already LTCH holders and do not have a clue about gun safety or proper CCW mindsets and responsibilities. The State should also make avaliable an LTCH brochure that informs the new LTCH holder of some very important laws, rules, etc. much like Ohio and other states do. There are too many people carrying guns that are ignorant of gun safety, cannot shoot properly, and think that it is legal to shoot someone who comes on their property, which as we all know, it not the case. Guns don't kill. .................Stupid people or bad people kill.
The "open carry makes you a target" position is a myth. You can find more cases where a gun was a deterrent.
A firearms instructor that wants it made law that someone has to take instruction to exercise a Right. hmmm
I do not believe that Mr. Ciyou will be responding. I don't think he's even registered a username here. From what I've seen, he's very pro-2A, he simply disagrees with the wisdom of OCing. Hell, for that matter, *I* disagree with the wisdom of carrying in "DTC" (that is, with the gun Duct Tape Carried to my forehead. It's completely legal; am I anti-2A for disagreeing with it? The man has a right to his opinion. Also, let's not forget that the 3rd ed. of his book was written and published long before the recent changes enacted by SEA 292.
IMHO, they are within their authority to approach and ask for LTCH, to state that they received a call and to state that OC can cause those calls.
It gets questionable after that, as up to that point, their actions can be called educating the public. (it's a stretch, but they can justify it that way)
It might be OK to ask if the OCer would be willing to conceal IF they made it very clear that it's only a request and that nothing will happen if the answer is "no". Note that I said it "might be OK".
Example:
LEO (after seeing and verifying LTCH): "Sir, I can't ask you officially to conceal your pistol. I'd like for you to do so, so that no one else gets called out to see your license again later, but it's entirely your choice. I'm just thinking it would keep you from being disturbed the rest of your day. Either way, I'm going to say "Thank you", wish you a good day, get in my car and leave. "
(Don't read more into that than is there... it's not like, "you have a beautiful family, be a shame if anything was to happen to them."
Telling him he had to leave or forcing him to leave is a good way to ensure that you meet Guy Relford.
Hope that helps!
Blessings,
Bill
Here's the Facebook page for Mesker Park Zoo. Hmmm....
Welcome to Facebook - Log In, Sign Up or Learn More
The City of Evansville does not have a FB site.
Update, here's what I posted on Mesker Park's FB site:
After reading about Mesker Park's illegal policy of evicting lawfully licensed persons practicing their 2nd Amendment rights, my family will not be frequenting your establishment. You at Mesker Park should read up on Indiana Code. You should also understand that the lawfully licensed gun owner is not the threat. The threat comes from those who do not have any concern for the law and they will most likely carry anyway, regardless of any policy.
My FB post on the Mesker Park Zoo Site was pulled. Whodathunkit?
