At the time, the Patriot Act had good intentions and still does. Given the gravity of what we were dealing we had to do something to ease the restrictions for intel gathering. However, with anything that was intended for good, someone will abuse it and make it bad.

I don't want to give up any of my rights for security or safety. Hitler would have been allowed to do everything he did with just the patriot act. Now the sunset safety was taken off. Just because the Government may or may not use that power doesn't mean they should have that power to begin with.

Fair enough. Just one question though. How would have gone about easing the intelligence gathering restrictions?

This is more or less what Luger and Beyh are getting from me..

    Senator XXX

I want to know why you think Mr. Sustein is worthy of any position in our government? I am hoping that maybe you just haven’t taken the time to do any research on this individual because if you had you surely couldn’t have voted for him with a clear conscience. Is someone a lot higher in our government promising you something if you vote for confirmation of his friends and the socialist aspirations of his regime?

You have proven to me once again that you simply don't care what your constituents want and what is in their best interests. I suggest that this is an appropriate time to start thinking about what you plan on doing after the next election. You have made it crystal clear to me and most everyone else in the State of Indiana that you no longer have any interest in serving 'We the people'. Yes, in case you had forgotten, you work for us, not the other way around.

I will be waiting anxiously for your reply but I realize that letters like this (I bet you get plenty) never make it past your aids or at best they will send me some cheesy catch-all form letter that has nothing to do with the subject at hand.

    Form letter reply..

    Dear JCJ:
Thank you for contacting me to express your opposition to the nomination of Cass Sunstein to be Director of the Office of Information and Regulatory Affairs in the Office of Management and Budget. I appreciate you taking the time to share your thoughts and views with me.
Article II, Section 2 of the Constitution gives the President the power to appoint "Officers of the United States" subject to the "Advice and Consent of the Senate." Under this framework, the Senate is given the authority to review the qualifications for office of the President's nominees. I take my duty to give "advice and consent" on Presidential appointments very seriously, and will continue to carefully review the President's nominees.

Some of Mr. Sunstein's critics expressed concern about his views on hunting. It may please you to know that throughout my public life, I have opposed legislation that fails to appropriately balance the need to maintain a safe society with the ability of law-abiding Americans to own and use firearms responsibly. I have always supported the Second Amendment and have opposed efforts to impose burdensome regulations on gun-owners. For example, earlier this year I voted to support the concealed carry amendment to the Department of Defense Authorization Act. This amendment would have allowed eligible, licensed gun owners to carry concealed firearms across state lines. I also supported an amendment to the Credit Card Accountability Responsibility and Disclosure Act of 2009 which would allow loaded weapons into National Parks and National Wildlife Refuges, overturning a previous ban on the practice.

Cass Sunstein testified before the Homeland Security and Government Affairs Committee on May 20, 2009. After debate on the floor of the Senate, he was confirmed by a vote of 57 to 40. Even though Mr. Sunstein has already been confirmed, please rest assured that I will keep in mind your views when considering future nominations.

Again, thank you for contacting me. I hope that the information I have provided is helpful. My website, Senator Evan Bayh — Senator for Indiana: Home, can provide additional details about my work in the Senate, including legislation and state projects. You can also sign up for occasional email updates. I value your input and hope you will continue to keep me informed of the issues which are important to you.
