I'm currently a student in Indiana but unfortunately not a resident. My goal is to own a pistol (glock 17) in Indiana although I'm a California resident. What would be the best way to go about that?

Is a lease in Indiana sufficient enough to purchase?
Should I buy in California and ship to Indiana?

Thanks. I am 21 so age is not an issue.

I would guess you could get a driver's license here and "move" to Indiana while you are in school. There are gun shop folks on here, one of them can probably answer your question.

I am pretty sure you would have to buy it as a CA resident and follow the laws of gun purchase in your home state. Going threw a FFL.

Is there a reason that you don't want to be a Indiana resident? It sure would make things simplier.

It's not necessarily that I don't want to but it would be the most difficult way since I would have to go to the BMV and take some test.

Do they not have drivers exams in California? It would be worth changing your residence for the state taxes alone.

My understanding is that California will not allow guns with high capcity magazines (> 10 rounds). So as long as your GLock has 10 or less you are ok. If you had a higher capacity mag that you owned before the law as a California resident you could still retain it but according to current California law you can't bring a high capcity magazine in with you. A quick way to check is to go to gunbroker.com and type in one the gun you want to buy and see if it can be shipped to a CA FFL. If it can't then you have your answer as a CA resident.

DISCALIMER: I am not a lawyer, so please do not take this as legal advice.

I believe this may be relevant.. Specifically the part in red..

    IC 9-13-2-78
    Indiana resident
Sec. 78. "Indiana resident" refers to a person who is one (1) of the following:
    (1) A person who has been living in Indiana for at least one hundred eighty-three (183) days during a calendar year and who has a legal residence in another state. However, the term does not include a person who has been living in Indiana for any of the following purposes:
    (A) Attending a postsecondary educational institution.
    (B) Serving on active duty in the armed forces of the United States.

    (2) A person who is living in Indiana if the person has no other legal residence.

    (3) A person who is registered to vote in Indiana.

    (4) A person who has a child enrolled in an elementary or a secondary school located in Indiana.

    (5) A person who has more than one-half (1/2) of the person's gross income (as defined in Section 61 of the Internal Revenue Code) derived from sources in Indiana using the provisions applicable to determining the source of adjusted gross income that are set forth in IC 6-3-2-2. However, a person who is considered a resident under this subdivision is not a resident if the person proves by a preponderance of the evidence that the person is not a resident under subdivisions (1) through (4).

    (6) A person who: (A) is enrolled as a student of a truck driver training school;
    (B) has legal residence in another state but is living in Indiana temporarily for the express purpose of taking a course of study from the truck driver training school; and
    (C) intends to return to the person's state of residence upon completion of the course of study of the truck driver training school.

So, you could not be considered a resident of Indiana, based solely on your Student status..

In addition.. My understanding is that you could not buy a handgun any where but your State of Residence..

I first became an Indiana resident 15+ years ago for this very reason and never looked back. For me purchasing was only a small part being able to get my carry permit was his biggest reason. Laws in MD are almost as bad as California.

Hehe, this is why you move to Indiana at least 6 months prior to starting school, so you get to be a resident. What part of CA did you move from? I'm from Alameda County.

I don't know about the cited IC. When I was enrolled as an Indiana Resident, I remember it said that if you start your first term as a non-resident, and pay non-resident fees, your residency status can be re-evaluated after. I don't know if you have to live off campus for this, or if I just mis-read it. Maybe other college students can chime in.

    I pay resident tuition btw.

I very well could be wrong, but if he was still claimed as a dependent on his parents taxes, on his parents insurance ect wouldnt he be forced to stay a ca resident?

Again, i may be (and probably am) wrong.
