    Even death? Sounds perfectly reasonable.

    Recklessly endangering innocent people? One should be allowed to do whatever is necessary to stop the foolishness including deadly force. If they end up being shot and die as a result......well they shouldn't have been doing that. A little different than using capital punishment for the crime of resisting in a motor vehicle.

    You have to remember that if someone flees from the police, in a vehicle, to avoid a misdemeanor marijuana arrest they have decided to commit a felony. Should their actions lead to their demise you cannot claim they were killed only for possession of marijuana.

    You are not saying everyone that runs should just be shot are you? I thought most felons were just arrested.

    You are not saying everyone that runs should just be shot are you? I thought most felons were just arrested.

    Not at all. What I am saying is that if someone commits a minor crime and chooses to escalate the situation to the point where deadly force is reasonably used against them, one cannot ignore everything else and claim they were killed for the minor crime.

    Tennesse v. Garner is no longer the standard in cases like this. The decision about the "fleeing felon" rule has been replaced with the "reasonableness" statute arising from Graham v. Connor. While Tennessee v Garner established a rule that fleeing felons could not be shot simply because they are fleeing, Graham v Connor expounded on that and established that shooting of a fleeing felon would be justified if doing so was reasonable according to the guidelines established. The guideline and test for reasonableness is "...the nature and quality of the intrusion vs. the govt's interest at stake..."

    you cannot apply TN v. Garner here if your only arguement is that they were shot while fleeing.

    No, if they are suspected of any felony they should be shot - at least 100 times.

    Yep, suspicion is certainly enough evidence to execute anyone. Just ask Judge Dredd.

    A bunch of people need to lose their jobs for this, and I am inclined to say there are probably more than a few that need to go to jail. The passenger, no matter what was in her system, was effectively murdered. Her only option when the driver refused to stop for LE was ride it out.
