I think the Global War on Terror achieves the same thing. All the President needs to do is remind people that the world is a dangerous place, and Americans will accept any number of extra-constitutional actions.

We are already in a national emergency that will never end.

By the way, I meant that literally

The U.S. has literally been under a constant State of Emergency since 9/14/2001. Martial Law is already authorized and legal at any time. The Federal Government may seize private property, restrict travel, control communications, etc.

Bush's proclamation:

Senate Report 93-549, written in 1973, sums up what the SOE proclamation means in layman's terms. This is from the forward.

These proclamations give force to 470 provisions of Federal law. . . . taken together, [they] confer enough authority to rule the country without reference to normal constitutional processes. Under the powers delegated by these statutes, the President may: seize property; organize and control the means of production; seize commodities; assign military forces abroad; institute martial law; seize and control all transportation and communications; regulate the operation of private enterprise; restrict travel; and, in a plethora of particular ways, control the lives of all American citizens.

The Washington Times put it pretty bluntly too.
