Just out of curiosity, could you tell me what reasons in your personal opinion, would qualify for asking for a search? And what reasons would qualify in asking for a warrant? Just so you know, and I'm sure you do know, a judge would ask during the application for a warrant, if the officer asked for consent. If he didn't, you can bet that the warrant wont be granted.
Why are the standards the judge would use to issue a warrant not be the same standards you should use when asking for a search ? If there is enough probable cause that you would ask for a search is there not enough to get a warrant?
If not, what are your standards to ask? Do you ask every encounter?
You know the law. Most of those you stop do not.
By you being trained in the law I see it as takking advantage of those that have not been trained.
I asked my wife and both of my daughters, all with college degrees," if a police officer asked you if they could search your car can you say "no"?
They all said they did not know.
I brought my children up to follow what a LEO would ask of them.
I have changed my instruction . . And use the magic words "I do not consent to searches" and otherwise keep their mouth shut.
