Anybody wonder whatever happened to common sense? Why bother charging Liberty?
The situation turned out okay, it doesn't sound like the shot was reckless and everyone (and animals) lived for another day.
Good luck with your court hearing.
Bigum, I agree with you. However, what would have happened if the officer just said, "Brother, I see this was necessary, so go on home" and the neighbors called the news about the incident? I can almost guarantee there would be accusations of fraternal nepotism because Liberty is a retired officer. Society forces common sense to be ignored in cases like this, because someone will complain and call the department corrupt and ask for the officer's job, because he would be labeled a bad cop.
I would have thought the prosecutor had something better to do, but he/she probably moved on it for the same reason. Now, we can only pray that the citizens of the great city of Carmel will use their common sense and trust the decision of an experienced officer who cut his teeth in the streets of Cincinnati(?) over that of a relatively new officer who probably encountered his first firearm call.

Not in Hamilton County. Ive been on the recieving end of a Hamilton County Prosecutors foot and my ass still hurts.
You are 100% wrong in your assessment. By your logic, every time a person uses a firearm in self defense, they should be charged with a crime no matter what the circumstances. And then hope and pray the prosecutor doesn't pursue it.
No, this guy should be labeled a "bad cop", because he is. I don't want to talk out of turn, but LS told me the last thing the Carmel LEO told him was "I'm going to do everything in my power to have your LTCH revoked!"
Does that sound like some one who is fair minded or objective? This guy needs to find a new line of work....
Calling neighbors should have been told he acted within the law protecting his property ...himself!
The prosecutor is backing Officer Miller who lied on his report.
A judge will be deciding not 'the citizens" .
