    I think as tradition ex-presidents were given access to classified intelligence briefings, but a current administration could revoke that access at any time.

    I don't remember who it was but it was some sleazy democrat official that lost his job right after Trump became President had a fit because he was loosing his clearances. Seems like the democrats defended it as a common practice to keep clearances even after leaving a position. Jim.

    Well, I doubt obammy could have passed a security clearance before he occupied the executive position. Once the position is occupied, tails on clearance follow to some extent.

    Hell, obammy is running his third term right now.

    EXCLUSIVE: The FBI seized boxes containing records covered by attorney-client privilege and potentially executive privilege during its raid of former President Trump’s Mar-a-Lago home, sources familiar with the investigation told Fox News, adding that the Justice Department opposed Trump lawyers' request for the appointment of an independent, special master to review the records.

    Sources familiar with the investigation told Fox News Saturday that the former president’s team was informed that boxes labeled A-14, A-26, A-43, A-13, A-33, and a set of documents—all seen on the final page of the FBI’s property receipt —contained information covered by attorney-client privilege.

    The FBI seized classified records from Trump's Palm Beach home during its unprecedented Monday morning raid, including some marked as top secret. But the former president is disputing the classification, saying the records have been declassified.

    If it comes to it, the Supreme Court will decide. THAT is certainly in the Constitution.
    Yes, if it comes to it, the Supreme Court will determine if the legislation in question can limit/eliminate a presidential candidacy that otherwise meets the requirements set forth in the Constitution.

    But, no, the power of the SCOTUS to determine whether legislation or Presidential acts are constitutional or not, is NOT in the Constitution. It was established by the court in Marbury v. Madison.

    The best-known power of the Supreme Court is judicial review, or the ability of the Court to declare a Legislative or Executive act in violation of the Constitution, is not found within the text of the Constitution itself. The Court established this doctrine in the case of Marbury v. Madison (1803).

    Color me shocked that our beloved and oh so rich with integrity FBI would knowingly seize documents they shouldn’t have. The next step will be finding another Epstein judge to further ignore the rule of law so they can continue the illegal witch hunt, use privileged information and spin half truths with it to piece together an “investigation” which will drag out as long as they can make it and result in the same ”success” that the ******** Russia Hoax and basically every other thing they’ve tried to do to the guy.

    If Trump announces and they can’t make something stick they’ll assassinate him before they allow him to hold that office again.

    I haven't seen much discussion around the fact that the warrant gave the FBI a window of up to two weeks to conduct the raid.

    One would think that alone undercuts the argument that this was truly a national security issue. If The documents posed such a threat to national security, the raid would have been carried out immediately.

    The affidavit allegedly asserting probable cause has not been made available to the public by the DOJ or the federal court that sealed it. The search warrant was signed on Aug. 5 and gave authorities two weeks to conduct the unprecedented raid. The federal magistrate who signed the warrant previously donated thousands to former President Barack Obama.

    I've seen this mentioned. I believe the judge was also publicly critical of Trump in the past.

    I think it was mentioned by Andy McCarthy that this was pretty much akin to a general warrant so they could go in and grab anything they wanted. Like I said previously. this wasn't just about retrieving "classified" documents. They used it as a pretext to do a fishing expedition to try and get the goods on Trump, most likely some evidence for the J6 clown show investigation. and the judge signed off on it.

    It was clearly a violation of the 4th Amendment.

    This seems relevant "...The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

    Oh, and to further inform the discussion. "
    THE Conventions of a number of the States, having at the time of their adopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added:..."

    Ponder that as the narrative of the raid unfolds.
