Isn't the most likely outcome, though, that SCOTUS will just deny cert and wait until another circuit court rules differently, resulting in disagreement among the circuits? If that happens, everyone not in the jurisdiction of 5DCA will kind of be left in limbo.It's a very well-written and thorough decision....almost like the judges think that it will be reviewed by the Supreme Court.

Yes, whether immediately or later, that's where this issue is headed.
